To all Tenderers
HOFOR hereby welcomes you to participate in the tender for 379414, HOFOR CC Tender .
If you are interested in participating in the tender, you will have to register online in the web based tender system of EU-Supply CTM. Registration is free and once you have registered you will obtain access to all published tenders in the EU-Supply’s web based tender system CTM, incl. future tenders.
After registration you will obtain access to the non-confidential part of the Tender Material. The Tender Specifications, including Appendix 1-3, 6 and 8-11 (Package A.1) will be available without NDA upon signing up in the electronic tendering system.
A Tenderer must sign a Non-disclosure Agreement (NDA) to get access to the confidential documents in the Tender Material. This material includes background information (Package B), contractual documents (Package C) and appendices to the Tender Specifications, incl. overview of the commercial model, the calculation model, the business case model, and Appendices 4, 5 and 7 (Package A.2).
A template of the NDA is available for download in the electronic tendering system as Appendix 11 in Package A.1. Once completed and signed the NDA must be submitted to HOFOR using the direct message function in the electronic tendering system. HOFOR reserves the right to refuse to enter into an NDA with a Tenderer who HOFOR considers to be in a conflict of interest, cf. information on grounds for exclusion in the Concession Notice and the Public Procurement Act section 136 (1), cf. the statutory order on the award of concession contracts section 5.
PROCES
The procedure is divided in four phases:
Phase 1: Contract Redlining Phase
Phase 2: Tender and negotiation Phase
Phase 3: Evaluation of tenders
Phase 4: Final negotiations
With a view to facilitate and incorporate as much market feedback as possible, HOFOR invites all interested Tenderers to submit comments on the published contracts in phase 1.
Submitting comments to the Tender Material is voluntary, however, all Tenderers who have submitted comments no later than the date stated in the Tender Specifications will be invited to participate in a negotiation phase, where the Tenderer and HOFOR will engage in negotiations relating to the submitted comments. The negotiation phase will take place from the 19 of November 2024 to the 5 December 2024.
Tenderers who have not submitted comments, will not be able to participate in such negotiations. However, Tenderers who have not submitted comments will still be able to submit an initial tender and receive feedback based on the initial tender, cf. section 4.2 of the Tender Specifications. Submitting comments is hence not a requirement for participation in the tender procedure.
Considering the deadline for submission of initial tenders is 6 December 2024, the Tenderer shall draft its initial tender (INDO) during Phase 1 in order to provide for sufficient time to prepare and submit the initial tender. The initial tender should hence be submitted based on the initial version of the Tender Material and any written answers submitted by HOFOR in the electronic tendering system.
Based on the received initial tenders, HOFOR will conduct negotiations/feedback rounds with the Tenderers regarding certain elements of the initial tenders, such as e.g. pricing and reservations set out in the initial tenders and give feedback on how to improve the tenders.
HOFOR explicitly reserves the right to conduct further negotiation/feedback rounds if considered necessary.
Following the negotiations, HOFOR will, if necessary, update the Tender Material and invite all Tenderers who has submitted an initial tender, to submit a best and final offer tender (“BAFO”).
HOFOR may submit further guidelines for submission of BAFO when announcing the call for best and final tender. The deadline for submittal of BAFO will be stated in the call for the BAFO. See the expected timeline in Appendix 2 to the Tender Specifications.
HOFOR reserves the right to resume to the negotiation/feedback rounds and ask the Tenderer for an extra BAFO if this is found to be possible in a given situation under the applicable Public Procurement rules.
Based on the evaluation, the Concession Contract is awarded to the Tenderer that has submitted the most economically advantageous tender based on the best price-quality ratio.
Following the award of the Concession Contract, HOFOR awaits the expiry of a standstill period of 10 calendar days, calculated from the day after the day when HOFOR has notified all tenderers of the award of the Concession Contract, before entering into the Concession Contract.
Following the expiry of the standstill period, HOFOR may carry out final clarifications and contract negotiations with the successful Tenderer. Whether or not any negotiations will be conducted is solely at HOFOR’s discretion, and the Tenderer cannot rely on such negotiations being conducted.

Questions concerning this tender procedure may be submitted using the Q&A module. All questions will be anonymized and will be published simultaneously to all Tenderers in the electronic tendering system together with the answer provided by HOFOR. Answers to questions regarding confidential documents will only be made available to Tenderers who has signed the NDA.
Questions that are not related to the tender and which are not to be published must be submitted via the “Direct Message” function. HOFOR reserves the right to refer the Tenderer to ask such questions via the Q&A module if the question is considered by HOFOR to concerns the tender.
