Questions for the Memorandum of Explanation can be submitted only in the English language through the Question and Answer module.

The 2012 Public Procurement Act ( 'Aw') and the 2013 Tendering Regulation for the Utilities Sectors 2013 (ARN2013) apply to this tender. These documents can be found on: www.lvnl.nl/over-lvnl/inkoop-en-contractering.

By submitting the filled in Selection guide in the manner described in the Selection Guide, you will become a Candidate for ATC-NL's Tender procedure and you will accept, without reservation, all conditions stipulated in the Selection Guide including all appendices thereto as well as the stipulated conditions in the Memorandum of Explanation.

Related to article 17.1 of the LVNL General Purchase Conditions 1 juni 2018 the Candidate has taken out and will maintain sufficient and adequate insurance against any liability towards ATC-NL relating to the Agreement or the performance thereof. This includes in any case: professional liability (risks arising from professional errors), corporate liability (including liability for damage or harm caused to persons or objects belonging to ATC-NL) and liability for loss of and damage to property of ATC-NL(including as a result of fire and theft).

You must prove this by submitting a certificate issued by your insurance company that clearly states the required categories. In case at present you do not have taken out the required insurance policy and therefore cannot submit such certificate, the legally signed European Single Procurement Document shall be construed as a statement that you shall unconditionally take out the required insurance at the time a contract is awarded to your company.

If this is not the case at the time of the contract is to be awarded, ATC-NL reserves the right to withhold the contract award.

To provide Initial Training (Basic and Rating Training) for ATC-NL the Candidate is required to be certified in accordance with Regulation (EC) 216/2008 and (EU) 2015/340 Part ATCO.OR Subpart A - E.

Candidate is required to provide evidence in the form of a reference statement that Initial Training (Basic and Rating Training) is provided according to the "Commision Regulation (EU) 2015/340" and the underlying "ATCO rules, Acceptable Means of Compliance (AMC) and Guidance Material (GM)" for an Air Traffic Controller Training Organisation (ATCO TO).
