Procurement of a patent renewal service

According to the Danish Patent and Trademark Office DTU was in 2022 ranked as the 5th most patenting entity in Denmark according to patent filings at the EPO. In 2022, DTU evaluated and decided on payments of around 400 patent renewals. In general, DTU uses the following patent filing process: filing of an EP priority founding patent application that is withdrawn before publication, and within the priority year file a PCT patent application claiming priority from the priority founding patent application. If DTU enters into national phase the minimum regions/countries are the US and EP. However, the actual selection is decided on a case-to-case basis. DTU’s main validation countries have until now been DE, UK, FR and DK, but after the start of UPC/UP, it is likely that DTU wish to obtain unitary effect via UP as an alternative, possibly combined with national validation in UK. The actual choice depends on the commercial partners or potential commercial partners. Thus, there will be variations from case to case, both with regards to the process of how we patent as well as which countries we will seek to protect.
